The following terms and conditions do not affect your statutory customer rights.

0. DEFINITIONS

Within these terms and conditions the following terms will be referred to: Seller meaning SureShots, Fraylings Business Park, Davenport Street, Longport, Stoke-on-Trent. ST6 4LN, United Kingdom and the company's web site, and sub-domains contained therein, which is www.sureshots.co.uk (www.wholesalefancydress.com)

Customer means the person or company to who purchase any products from SureShots.

International Customer shall mean, Customer from outside the United Kingdom.

1. GENERAL

These terms and conditions are applicable to the supply of products made by the Seller, hereafter referred as SureShots, to the buyer hereafter referred as the Customer.

SureShots and/or its respective suppliers make no representations about the suitability of the information contained in the documents and related graphics, or the products found on this website, published on this server for any purpose. All such documents and related graphics are provided "as is" without warranty of any kind. SureShots and/or its respective suppliers hereby disclaim all warranties and conditions with regard to this information, including all implied warranties and conditions of merchantability, fitness for a particular purpose, title and non-infringement. In no event shall SureShots and/or its respective suppliers be liable for any special, indirect or consequential damages or any damages whatsoever resulting from loss of use, data or profits, whether in an action of contract, negligence or other tortuous action, arising out of or in connection with the use or performance of information available from this server.

The documents and related graphics published on this server could include inaccuracies or typographical errors. Changes are periodically added to the information herein. SureShots and/or its respective suppliers may make improvements and/or changes in the product(s) described herein at any time.

2. PRICE

2.1 All prices are quoted in pounds sterling (£) and are exclusive of VAT (as may be prescribed by law from time to time), unless otherwise specified.

2.2 All prices are exclusive of postage and packing, unless otherwise stated. Postage charges are shown at the checkout stage of the order and will be added to the order total. If placing your order by telephone, you will be informed of the postage charges at the time of order. Postage charges are the same no matter how you place your order, however they vary depending on delivery address and consignment weights / volumes.

3. PAYMENT

3.1 Payments must be made in pounds sterling (£) only, unless otherwise specified, and by one of the following payment methods (except International Customers see clause 11)

· Credit card. Visa, MasterCard, Solo & Switch.

· Cheques; made payable to SureShots Ltd. (Payment by Cheque must be authorised prior to ordering by calling our trade department on 0870 8338 390).

· Postal orders made payable to SureShots (Payment by Postal Orders must be authorised prior to ordering by calling our trade department on 0870 8338 390).

· Valid SureShots credit note, issued by SureShots (Payment by Credit Note must be authorised prior to ordering by calling our trade department on 0870 8338 390). In all cases the original credit note must be returned to SureShots within 7 days of the order being placed. The customer will be held responsible for full payment in the event of the credit note not being received either in time, or not at all. (We recommend that credit notes be returned using trackable delivery methods for customer security.) The customer will be responsible for all charges incurred for sending the credit notes to SureShots.

The goods shall remain the property of SureShots until the customer has made full payment or until (where applicable) the original credit note is returned to SureShots.

SureShots will charge 11% per day of the outstanding balance overdue, if payment is not received within the terms on this site or on your invoice.

Any Solicitors fees incurred in the recovery of a late payment will be charged to the customer.

4. CLEARED FUNDS

We will only ship products on cleared funds. If you require special clearance of a cheque to speed up delivery please call us on 0870 8338 380. This service costs £12.00.

5. PASSING OF RISK

The risk in the goods shall pass to the Customer on delivery, as defined in clause 6.3 below.

6.1.1 DELIVERY DATE

Any date or period for delivery shall be considered as indicative only.

However, it is our aim to dispatch all domestic orders within 24 hours of the order being placed (Saturday's / Sunday's / Bank Holidays excluded). All trade orders are sent via courier for guaranteed next (working) day delivery. In most instances orders placed before 12pm will usually be with the customer the following day.

Details of the estimated delivery time are given when you check out. If the total delivery time for the order exceeds 30 days, it is our policy to contact the customer and inform them of this. If your order will not be received within 30 days you are given the choice to cancel your order for a full refund.

SureShots cannot be held responsible for delays in the delivery caused by the manufacturer, courier, or any other third party.

6.1.2 DELIVERY DATE FOR ORDERS WITH OUT-OF-STOCK ITEMS

If any products in your order are not available at the time of order, you will be contacted via email once the order has been processed and sent for shipping, this email will notify you of any items that you will not be receiving due to stock availability issues or any other reason again, the customer will be informed specifically as to the reason why the goods will not be shipped.

6.1.3 CREDIT NOTES FOR NON-SHIPPED ITEMS

In the event of payment being taken for goods that are not delivered due to stock issues the customer will be issued with a credit note for the total amount of those products that were not received.

6.2 SHIPPING

Most orders are sent through City-Link, Lynx or Royal Mail (which may involve Parcel Force). Unless otherwise specified all products are shipped by Couriers on Guaranteed NextDay Delivery Services or Royal Mail Packet Post. International Orders are sent via couriers and delivery timescales are indicative only. All couriered deliveries must be signed for.

Some larger orders, or orders with specific guaranteed services, may be sent via a different courier.

The Customer must request any other delivery method they may require at the time of the order, and if we agree that this is a suitable method of delivery, goods will be shipped under Customer's responsibility as defined in clause 6.3.

6.3 PASSING OF RISK

6.3.1 The customer bears the risk of the goods once they have been signed for. In the case of goods being shipped out via none trackable means, the customer bears the risk of the goods as soon as they have left the SureShots premises.

6.3.2 When an order is returned to SureShots, the customer bears the risk of the goods, and is held responsible for them until they are received by SureShots.

7. RETURNS PROCEDURE

7.1 SureShots Ltd does not operate a 'sale or return' policy.

7.2 In cases where the rejection of the goods is due to a fault or defect or an error in the order (for example, the incorrect items have been sent), the Customer is entitled to a full refund or replacement (postage charges will also be refunded). The faulty or damaged product must be returned to SureShots before the refund or replacement can be issued. The customer is given up to 30 days after receipt of the order to return the goods to SureShots, however they must still comply with the Acceptance procedure in clause 7, and contact SureShots within 7 days of receipt to inform of the return.

8. CANCELLATIONS

8.1 Cancellations are only accepted if the Customer complies with the following cancellation procedure and before the order has been despatched. If the procedure is not respected, the order will be considered valid and the Customer will remain liable for the full payment.

8.2 Cancellations can be made with SureShots sales line on 0870 8338 390. A member of staff at SureShots will confirm the cancellation; we recommend that you make a note of the staff member's name. If the cancellation is successfully made before despatch, we will totally cancel your order and there will be no charge whatsoever.

9. LICENSE AGREEMENT

The Customer shall respect all license agreements delivered by the copyright owners. SureShots cannot be held responsible or liable for any misuses conducted by the Customer or any third party.

10. LAW

These terms and conditions are governed and shall be interpreted in accordance with all United Kingdom and Great British laws.

11. COPYRIGHT

The content of this website is protected by copyright. The layout and design is protected. All rights reserved. Smiffy's is a trademark of Smiffy's in Gainsborough, England.

Customer may electronically copy, or print in hard copy, the websites content for the sole purpose of placing an order, or for reference to our products and services. Any other use of materials on this Web site - including reproduction for purposes other than those mentioned above, modification, distribution, or republication - without the prior written permission of SureShots is strictly prohibited.

Making A Purchase Some products on this site come in multiple quantity units, and therefore must be bought in those quantities or multiples of. Where this is the case a minimum quantity will be specified and you will have to order at least this amount. If you order above the minimum and not in multiples of the packsize we will make your order up into the smallest packsize encompassing the quantity you require.

Making a purchase could not be easier. Just browse our store, and add any items that you wish to buy into the shopping cart. After you have finished your selection, click on 'Checkout' and you will be asked for a few details that we need to be able to complete the order.

We accept Visa, Switch, Debit Cards and Mastercard. We do not charge for any item until it is ready to ship.

When confirmation of order is received, this is to indicate that we have received your order. It does not indicate that a contract exists between us. We will indicate acceptance of your order, and hence a contract between us, when we send you an invoice. We have included this term to protect us in the case that a mistake has been made in pricing, we have inadvertently under-priced goods, or we are no longer able to supply a particular product for some reason. In the case of a change of price, we will always contact you first to ensure that the price is acceptable.
Shipping And Handling charges are displayed on the website and are valid for UK mainland only. Customers will be notified of any additional charges applicable to an order for either over water carriage, international carriage, multiple box consignments, high weight consignments or any other abnormal deliveries. In all cases, customer acceptance to these additional charges will be required before payment is taken and the order shipped.
Tax Charges For orders made from the UK or the European Union, 17.5% VAT is added. All other orders are VAT free.
Credit Card Security When the order is placed at our website, credit card numbers are encrypted using 128 bit encryption. They are only decrypted after they reach our computer. They are not held in clear text on any web site.

There is a low minimum order value of just £225 excluding VAT and delivery (£264.38 total). Please note that products without VAT such as Children's costumes will affect the minimum order value as the lack of VAT on these products cannot be taken into account with regards to the minimum order value.
